If a Diversity Visa (Green Card Program) selectee dies, what happens to their DV case?



If the principal applicant (the person selected in the Diversity Visa Program) passes away before the visa is issued, their case is automatically and permanently revoked. This means that any eligible dependents, including a spouse or children listed on the original application, will no longer be eligible to receive a Diversity Visa based on that entry.

Unfortunately, under U.S. immigration law, the diversity visa is tied directly to the principal applicant. If the principal applicant is no longer alive, the qualifying basis for the visa no longer exists, and the case cannot proceed. Dependents must reapply and be selected in their own right in a future Diversity Visa Program to immigrate.
